Terms of Service

These Terms of Service ("Terms") govern the use of the Aquila Closets website and the purchase of products and services from Aquila Closets ("Aquila Closets," "we," "us," or "our"). By using our website or entering into an agreement for products or services, you agree to the applicable provisions of these Terms, together with any signed proposal, estimate, design approval, contract, or other project-specific agreement.
1. Our Services
Aquila Closets provides custom storage and organization solutions, which may include design, measurement, fabrication or procurement, delivery, and installation of products such as custom closets, walk-in closets, reach-in closets, wardrobes, shelving, cabinetry, storage systems, and related products. The exact scope of each project will be stated in the customer's proposal, estimate, order, or contract.
2. Consultations, Measurements, and Estimates
Customers are responsible for providing accurate information regarding the project and property. Quotes and estimates are based on the information, dimensions, materials, finishes, accessories, design, and scope known at the time they are prepared. Pricing may change if the customer requests modifications or if previously undisclosed site conditions materially affect the work. Unless otherwise stated in writing, an estimate does not constitute a binding agreement until the applicable contract or proposal is accepted and any required deposit is received.
3. Custom Designs
Designs, renderings, drawings, samples, and digital representations are intended to communicate the proposed project. Computer-generated renderings and screen colors may differ from the appearance of actual materials because of lighting, monitor settings, natural material variations, manufacturing differences, and other factors. Customers are responsible for reviewing dimensions, layout, colors, finishes, hardware, accessories, and other specifications before approving the final design.
4. Customer Approval
Once a customer approves a final design or order, Aquila Closets may begin ordering, cutting, fabricating, or otherwise preparing custom materials. The customer is responsible for reviewing the approved design carefully before authorization. Changes requested after approval may result in additional charges, material costs, redesign fees, restocking fees where applicable, and changes to the estimated completion or installation date. Some changes may not be possible after custom manufacturing has begun.
5. Deposits and Payments
The required deposit and payment schedule will be identified in the applicable proposal or contract. A project may not be scheduled for production, material ordering, delivery, or installation until the required payment has been received. Remaining balances must be paid according to the customer's contract or invoice. Failure to make payments when due may result in suspension of work, postponement of installation, collection activity, or other remedies permitted by the applicable agreement and law.
6. Custom Products
Many Aquila Closets products are specifically measured, designed, ordered, cut, or manufactured for an individual customer's space. Because of their customized nature, cancellation and refund rights may be limited once the customer approves the project and custom production or material ordering begins, subject to the customer's contract and any rights provided by applicable law. 7. Scheduling and Installation
Installation dates and completion estimates are provided in good faith but may be affected by circumstances beyond our reasonable control, including manufacturer delays, material shortages, transportation delays, weather, building restrictions, customer-requested changes, site conditions, or other unforeseen circumstances. Customers must provide reasonable access to the installation area at the agreed-upon time. Unless otherwise agreed, the installation area should be reasonably clear and accessible before installers arrive.
8. Site Conditions
Customers must disclose known conditions that could affect installation, including plumbing, electrical wiring, heating systems, hidden utilities, structural issues, water damage, or other relevant conditions. Certain conditions concealed behind walls, ceilings, floors, or existing construction may not be reasonably detectable during ordinary measurements. Additional work resulting from unforeseen site conditions may require customer authorization and additional charges.
9. Customer Responsibilities
The customer is responsible for:
- Providing accurate project and contact information
- Reviewing and approving designs and specifications
- Providing reasonable access to the property
- Removing personal belongings from installation areas when requested
- Identifying known concealed utilities or hazardous conditions
- Obtaining building, condominium, cooperative, landlord, or property-management approvals when applicable
- Making payments according to the agreed schedule
10. Product Variations
Colors, textures, grain patterns, finishes, and other characteristics may vary between samples, photographs, renderings, production batches, and finished materials. Minor variations that are normal for the applicable material or manufacturing process are not necessarily defects.
11. Inspection After Installation
Customers should inspect completed work within a reasonable period after installation and promptly notify Aquila Closets of any alleged defect, damage, missing component, or installation concern. We will evaluate reported concerns and determine the appropriate corrective action consistent with the applicable contract, manufacturer's warranty, and law.
12. Warranties
Any project-specific workmanship warranty will be identified in the applicable contract or warranty documentation. Products, hardware, accessories, or materials manufactured by third parties may be covered by separate manufacturer warranties and subject to the manufacturer's conditions and exclusions. Warranty coverage generally does not extend to damage caused by misuse, abuse, unauthorized modifications, improper maintenance, excessive loads, water or moisture, structural movement, accidents, normal wear and tear, or work performed by third parties, except where otherwise required by law.
13. Website Content
The Aquila Closets website is provided for general informational and promotional purposes. We attempt to maintain accurate information but do not guarantee that all website content, product descriptions, pricing, photographs, or availability will always be complete or current. A website price or description does not supersede the terms of an accepted project proposal or contract.
14. AI-Generated Images & Renderings
Aquila Closets may use artificial intelligence (AI), computer-generated imagery, digital renderings, digitally enhanced photographs, and other visualization technologies in its website, advertisements, social media, design presentations, and marketing materials. Such images are provided for illustrative, conceptual, and inspirational purposes and may not depict actual projects completed by Aquila Closets.
Visual representations may differ from actual products or completed installations, including differences in color, texture, lighting, dimensions, proportions, materials, hardware, accessories, and finishes. Customers should rely on their approved drawings, measurements, material selections, specifications, proposals, and contracts when making purchasing decisions. Final results may vary from conceptual or AI-generated imagery.
15. Intellectual Property
The Aquila Closets name, branding, logos, website design, original photographs, graphics, drawings, renderings, text, and other original content may be protected by intellectual-property laws. Nothing in these Terms grants permission to reproduce, distribute, modify, commercially exploit, or use our protected materials without authorization except as permitted by law.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Aquila Closets will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or products and services. Nothing in these Terms is intended to exclude or restrict liability or consumer rights that cannot legally be excluded or restricted.
17. Force Majeure
Aquila Closets will not be responsible for delays or failure to perform caused by circumstances beyond our reasonable control, including severe weather, natural disasters, governmental actions, transportation disruptions, labor disruptions, supply-chain interruptions, manufacturer delays, material shortages, or similar events.
18. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.
19. Changes to These Terms
We may modify these website Terms periodically. Updated Terms become effective when posted unless otherwise stated. Changes to website Terms do not retroactively modify a separately executed customer contract unless agreed to by the parties or otherwise permitted by law.
